The National Consumer Law Center claims United States Copyright and international intellectual property rights to the content provided on library.nclc.org. You may not share passwords or documents with unauthorized users, except as provided in this terms of use. Certain material and linked third party sites may be subject to their own copyright and terms of use. Individual Terms of Use
- Registration is required to access certain content on this site. Each registration is for a single user only, unless otherwise expressly provided by the National Consumer Law Center. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. If you believe there has been unauthorized use, you must notify us promptly at publications@nclc.org or call 617-542-9595.
- Use of subscription content on library.nclc.org is subject to full payment of the current subscription period.
- Registered users can purchase additional digital versions for use by a single user only, and for use only within the same organization. Users of additional digital versions are subject to these same terms of use.
- Users are entitled to view/search the content, download, print, or email individual pages of the treatises and documents/files found in the companion material to which they have access, all for personal or educational use, to collaborate with others, or to present to a court or agency or legislature. Users should be aware that NCLC views its password protection system to be a technological protection measure the circumvention of which is a violation of the Digital Millennium Copyright Act.
- Users are NOT entitled to copy content on library.nclc.org (the “Content”) and publish that Content on a website or distribute it for commercial purposes. Without limiting the foregoing, users may not use or incorporate any Content for training or developing any form of large language model (LLM) or artificial intelligence (“AI”), including in any generative or other form of AI. This prohibition extends to the use of apps, web crawlers or other automated devices for the purpose of scraping Content for later use or distribution, including the training of LLMs or generative AI.
- Any one user name is NOT entitled to access the digital library from more than five IP (internet protocol) addresses and/or devices within a 24-hour period.
- Users may NOT attempt to gain unauthorized access to any services, accounts, computer systems, or networks connected to any server used for this website, through password mining, hacking, or any other means. You will not seek to gain access to any content on library.nclc.org through any means not intentionally made available by us.
- You acknowledge and agree that the National Consumer Law Center, in its sole discretion, may terminate your subscription access to library.nclc.org if your conduct is found to be unlawful, inconsistent with, or in violation of, the letter or spirit of these terms of use, or for any other reason in our sole determination. Should you object to any terms and conditions of these terms of use, or to any subsequent modifications thereto, your only recourse is to immediately discontinue use of the website.
- Content on library.nclc.org may not be used to engage in the unauthorized practice of law.
Institutional / IP Terms of Use
- Users with IP access or remote IP access (including students and faculty at law schools where the law school has remote IP access) are subject to the preceding terms of use.
- Law school law library entire set purchasers with remote IP access are entitled to IP access for all computers residing in the law school (but not within the university outside the law school) and may offer remote connection to all law school faculty and students, but not to others. Others with remote IP access are entitled to IP access as determined by their agreement with the National Consumer Law Center as to the extent of the IP use.
- Other set purchasers with IP access that does not include remote IP access are entitled to IP access to all computers within one building but not any devices outside the building.
Limited Warranty
- The National Consumer Law Center represents and warrants that it has the right and authority to make these digital library resources available to you and your authorized users as authorized expressly by these terms of use.
- Except as stated above, the content on library.nclc.org is provided “AS IS,” without additional warranty of any kind, including, but not limited to:
- Warranties of performance, merchantability, fitness for a particular purpose, accuracy, omissions, completeness, currentness, and delays
- Warranties that access to any product will be uninterrupted, secure, complete, or error free warranties as to the life of any URL or third-party website.
Provision of content entails the likelihood of some human and machine errors, delays, interruptions, and losses, including the inadvertent loss of data or damage to media.
Although National Consumer Law treatises and other content on the site are periodically updated, National Consumer Law Center, the National Housing Law Project, and the National Center for Law and Economic Justice do not represent that treatises or other content on the site at any given point in time contain the most recent statutory, regulatory or case law on an issue or cover all aspects of that topic.
This site and its content is not intended to meet specific customer requirements which have not been expressly agreed upon between the customer and the National Consumer Law Center.
Liability
In no event will the National Consumer Law Center be liable, in contract, tort, strict liability, or otherwise, for:
- Indirect, incidental, special, punitive, or consequential damages of any kind arising out of, or in connection with use of this website
- Any claim(s) relating in any way to customer's inability or failure to perform research or other work or to perform such research or work properly or completely, even if assisted by the National Consumer Law Center

Enforcement
By agreeing to these terms of use, as amended from time to time, you agree also that any dispute concerning or related to these terms of use, is to be resolved solely and exclusively in state or federal courts located in the Commonwealth of Massachusetts.
You agree further that these terms of use shall be governed by the substantive law of the Commonwealth of Massachusetts and the federal laws of the United States.
